Selling Your HDB Flat With a Temporary Extension of Stay: How the 3-Month Arrangement Works

By Published

HDB sellers who have committed to buy a completed property can ask the buyer to let them stay up to 3 months after resale completion. Here is who qualifies, what each side pays and how to apply.

Quick answer

Yes. When you sell your HDB flat, you can ask the buyer for a temporary extension of stay, which lets you remain in the flat for up to 3 months after the resale completion date. It is a private arrangement that needs the buyer’s agreement and HDB’s approval, and it ends automatically at 3 months with no further extension.

It is only open to sellers who, by the time they submit the resale application, have committed to buy a completed property in Singapore, by exercising an OTP or signing a Sale and Purchase Agreement. You must also not be renting out the whole flat. If your next home is still under construction, this arrangement does not cover the gap, so plan your timeline before you grant the OTP.

Key takeaways

  • An HDB seller can stay in the sold flat for up to 3 months after resale completion, if the buyer agrees and HDB approves.
  • You must have committed to buy a completed property, HDB or private, when you submit the resale application.
  • The extension ends automatically at 3 months. HDB does not allow a further extension.
  • From completion, the buyer is the legal owner and pays the loan, S&CC and property tax, even while you are still living there.
  • The buyer’s minimum occupation period only starts after the extension ends, which is a real cost to the buyer.
  • Any compensation is a private matter between you and the buyer, and it cannot be built into the resale price.

Background

Normally, HDB sellers must vacate the flat before the resale completion appointment. That is difficult when the seller’s next home is ready only a few weeks later, because the two completion dates rarely line up exactly.

HDB’s temporary extension of stay closes that gap for sellers whose next home is already completed. HDB treats it as a private arrangement between seller and buyer, separate from the resale itself. The resale still completes on the agreed date, and the seller simply hands over vacant possession at the end of the extension instead of on completion day.

Who is affected

This guide is for HDB flat owners who are selling and buying at the same time, and whose next home is a completed property: an HDB resale flat, a resale condo or another completed private home. It is most relevant when the completion date of your next home is likely to fall after the completion date of your HDB sale.

It is also useful for buyers deciding whether to agree to a seller’s request. The HDB resale page covers the wider selling process.

Who is not affected

If, when you submit the resale application, you have not yet committed to buy your next home, or your next home is a property that is not yet completed, you do not meet HDB’s seller condition. That includes sellers waiting for a new launch condo, a new EC or a new flat that is still being built.

It also does not apply if you are renting out the whole flat at the time of the resale application. If your sale is under the Enhanced Contra Facility, only the contra party can apply.

What remains unchanged

  • The resale still completes on the agreed date; the extension does not delay legal completion.
  • The resale price is agreed in the usual way and cannot include any compensation for the extension.
  • You must still submit your portion of the resale application within the agreed period and within 7 calendar days of the buyer.
  • The buyer still has to meet HDB’s eligibility and financing requirements.
  • HDB will not mediate if you and the buyer later disagree about the arrangement.

Planning considerations

1. Confirm your next home qualifies before you grant the OTP

HDB’s condition is that you have committed to buy a completed property in Singapore, by exercising an OTP or signing a Sale and Purchase Agreement, by the time you submit the resale application. Check this before you promise a buyer any dates. If your next home is still under construction, plan for temporary housing instead. The guide to selling your HDB before buying a condo covers the sequencing choices.

2. Raise the extension during negotiation, not after

HDB advises sellers and buyers to discuss the extension while negotiating the sale, and it needs the buyer’s agreement. Asking after the OTP is signed leaves you with little leverage. Agree the length of stay, which can be up to 3 months, before you grant the OTP. The HDB seller OTP checklist covers the other points to settle first.

3. Understand what the buyer gives up

During the extension, the buyer already owns the flat and pays the housing loan, service and conservancy charges without rebates, and property tax at non-owner-occupier rates. Their minimum occupation period also starts only after you move out. That is why some buyers ask for compensation, and why others decline. Being clear about these costs helps both sides agree fair terms.

4. Put the private terms in writing

HDB allows you and the buyer to sign a private agreement, including any monetary compensation from you to the buyer. HDB does not need to see it and will not mediate disputes, and both parties must indemnify HDB. HDB’s terms also advise including a written-notice termination clause and setting out what happens if either side cancels before completion.

5. Declare it in the resale application

You and the buyer each state the extension in your own portion of the resale application. HDB then processes the request and asks both of you to endorse it before the extension starts on the resale completion date. Sellers pay no administrative fee; the buyer pays $20, inclusive of GST.

6. Keep to the occupancy rules during the stay

Only you and the occupiers listed with HDB at the time of resale may stay. The approval does not cover tenants, including room tenants. HDB can revoke its approval if the terms are breached, and the buyer would then have to move in immediately.

7. Plan the move-out date and any changes

The extension ends at 3 months or on earlier termination, whichever comes first, and you must vacate at your own cost. If you leave early, the buyer must inform HDB. If your own purchase falls through, HDB’s approval is automatically revoked. If you want help timing your sale and your next purchase, the HDB resale page explains how Melvin supports HDB sellers.
